Chapter 83, Part II of the Florida Residential Landlord-Tenant Act has no provisions that prevent a Landlord from misusing the common law against helpless tenants. WKMG has run entire stories on this abuse. Many have privately written to our law makers to make a change to assist good tenants. Victim of Arbitrary Non-Renewal of Lease
Senior Citizen RV Park in Fort Myers Beach is sending letters to tenants, stating they are terminating their lease. The correspondence requires they turn their title over to the park within a specified time frame (ours was less than 2 weeks) and they will demolish without fine. If you do not, and your unit is not removed in 30 days, you will get charged double lot rent. This correspondence is very intimidating causing many to relinquish their rights and providing RV titles to the park, losing their units.
ReplyDeleteThis letter/decision was made 8 months after hurricane Ian. We followed and adhered to any and all requests made by the park. They were well informed of intentions and approval through Lee County to rebuild.
Money has been invested in re-build. The park is currently inhabitable by tenants, as there is no power or sewage, lot rent is up to date prior to the hurricane.
They are clearly taking advantage of our senior communities.
